Buying an apartment in Ukraine requires careful preparation on both sides of the transaction. Both the seller and the buyer must have all the necessary documents to ensure the legality and security of the transaction. Improper preparation can lead to legal complications and financial risks.

What documents must the seller provide to sell an apartment in Ukraine?


To conduct an apartment purchase and sale transaction, you need to prepare a package of papers in advance. Below is a list of documents required from the seller.


Personal documents


A passport and TIN are required. If the housing has several owners, documents are provided from each.


Title documents (original)


This can be a purchase and sale agreement, a certificate of inheritance, a court decision or another document confirming the right of ownership. It is important that the right is entered in the State Register of Property Rights. If registration was carried out before 2013, a certificate from the BTI is additionally required.


Technical passport for an apartment


Contains information about the layout, area, floor and redevelopment. It can be issued at the BTI or through a licensed organization.


Certificate of registered persons


Before the sale, all registered residents must be discharged. The certificate can be obtained from the ASNAP or from a notary. If necessary, a document confirming the absence of debts for utility services is attached.


Extract from the State Register


Ordered online. Contains information about owners, co-owners, as well as existing encumbrances (pledge, mortgage, etc.).


Real estate valuation


Formed online through the State Property Fund. If the valuation is not suitable, it is allowed to contact a private appraiser.

What documents does a buyer need to purchase an apartment in Ukraine?


The package of documents from the buyer is usually smaller than that of the seller. The main list for citizens of Ukraine looks like this:


- Passport (ID or booklet);

- TIN (taxpayer card);

- Marriage certificate - if the person is married;

- Notarized consent of the other spouse to the purchase (not required if both are present when the transaction is concluded).


To avoid delays on the day of signing the contract, it is best to coordinate the full list of documents with the notary in advance.

Among the key documents that you should pay attention to:


- constituent documents of the developer;

- building license;

- permits for the construction of a specific facility;

- documents for a land plot;

- project documentation.

What does a notary check before signing a real estate purchase and sale agreement in Ukraine?


Before concluding a transaction, a notary not only clarifies what documents are required for the sale of an apartment, but also checks them independently. His task is to make sure that the real estate is legally “clean”.


The notary checks through the State Register of Real Rights to identify possible:

- arrests;

- tax liens;

- mortgages;

- other restrictions or prohibitions on alienation.


If the apartment is under arrest or mortgage, the sale is possible only after the restrictions are lifted or with the consent of the mortgagee.

The specialist also checks the seller’s documents, the presence of marriage, the number of owners and the consent of the other spouse. Additionally, a certificate of persons registered in the apartment is requested - it is desirable that no one was registered at the time of the transaction.

If necessary, the notary analyzes the history of the transfer of ownership.


Important! During martial law, only notaries have official access to state registers, so the transaction cannot be executed without their participation.


What documents does the buyer receive after a real estate purchase and sale agreement in Ukraine?


After the transaction is completed, the buyer is given a package of documents confirming the ownership:

- Purchase and sale agreement;

- Extract from the State Register of Property Rights;

- Technical passport;

- Document confirming the absence of debts for utility services;

- Seller's legal documents;

- Property valuation;

- Certificate of family composition;

- Notarial consent of the seller's other spouse;

- Receipts for payment of taxes and duties.


These documents are confirmation that the new owner has acquired full rights to real estate.


What documents are needed by a foreigner to buy real estate in Ukraine?


To purchase real estate, a foreign buyer must prepare the following package of documents:


- a valid international passport;

- a notarized translation of the passport into Ukrainian;

- an identification code (TIN);

- in some cases, confirmation of the origin of funds or other financial documents.


If a transaction is made on behalf of a foreigner by a representative, the power of attorney must be notarized.


What taxes does a foreigner pay when buying real estate in Ukraine?


If a foreign seller has owned real estate for less than three years (and for foreign residents, rates may be separately determined by the Ministry of Finance), the tax burden remains standard. The payment includes:


- pension levy – 1%;

- state duty – 1%;

- military levy – 1.5%.


At the same time, the personal income tax rate is increased from 5% to 18%.


Rental Taxation


When renting out real estate, income is taxed at a single rate - 18% of the actual amount of rent. This rule applies equally to Ukrainians and foreigners, residents and non-residents.


Real estate ownership tax


The amount of the tax depends on the area of ​​the property. Owners of apartments up to 60 m², houses up to 120 m² or residential premises up to 180 m² are exempt from paying the tax.

If the area exceeds these limits, the following rates apply:

- for apartments - 0.5% of the minimum wage,

- for houses - 1% of the minimum wage.
