For foreigners, buying real estate in Bali does not mean obtaining ownership of the land. According to Indonesian law, ownership rights (Hak Milik) are not available to foreigners. Instead, other mechanisms are used:


Leasehold (Hak Sewa): a long-term lease for 25-30 years with the possibility of renewal.

HGB (Hak Guna Bangunan): the right to build and use through a local company.

PT PMA: an Indonesian company with foreign capital that meets all requirements.


It is important that the agreement is legally sound. Foreigners often sign contracts without considering their goals and may not get what they expect.

A development agreement ≠ a secure agreement


An agreement with a developer in Bali is not a standard of security. It often serves to protect the interests of the seller, not the buyer.


The main risks include:

No penalties for missed deadlines.

Possibility of changes in planning without approval.

Unclear land status and zoning.

Sale of properties without a full set of documents.


Signing such a contract does not guarantee the legality of the property.
