Foreigners or stateless persons who have purchased real estate in Ukraine or inherited it have the opportunity to dispose of it. At the same time, non-residents often face problematic issues related to document flow, conclusion of contracts, their translation and notarisation. Sale and purchase agreements with foreigners are regulated by the Law of Ukraine ‘On Private International Law’. In this article, we have gathered information on how a foreigner can sell real estate in Ukraine quickly and smoothly.
What kind of real estate can a foreigner sell?
Under the current legislation, real estate in Ukraine is divided into 3 categories:
- land
- residential buildings;
- non-residential premises.
All three subtypes are available for sale to non-residents, but there is a nuance in the case of land sales. Foreigners do not have the right to own agricultural land in Ukraine. If a foreigner inherits agricultural land, he or she must dispose of it within a year. And in this case, the sale of real estate (as one of the main types of alienation) is more of a duty than a right.

Key conditions for concluding a sale and purchase agreement for a foreigner
1. A non-resident must be over 18 years old.
2. If the electronic document management system is not used when signing the agreement, the foreigner's stay in Ukraine must be legal, i.e. confirmed by documents from the migration service (visa, temporary residence permit, etc.).
3. The apartment must be appraised in advance.
4. Documents related to the conclusion of the contract must be submitted to the notary in advance.

What documents must a foreigner have to enter into a sale and purchase agreement in Ukraine?
Please note! All foreign documents must be translated into Ukrainian and certified by a notary public.
1. Passport.
2. Residence permit.
3. Marriage certificate.
4. Consent of the other spouse to the sale of the property (if the property was purchased when the foreigner was already married).
5. Card of an individual taxpayer (can be obtained from the State Tax Inspectorate by providing them with the above package of documents).

What documents should a Ukrainian have to buy real estate from a foreigner?
1. An individual licence issued by the NBU, which allows the use of foreign currency and the transfer of money abroad (if the non-resident has an account with a foreign bank).
2. A document confirming the legal possession of money (if the transaction amount exceeds UAH 150 thousand).
