In the context of a full-scale war against russia, Ukraine is enlisting not only its own citizens to defend the state, but also foreigners and stateless persons who have voluntarily joined the ranks of the Armed Forces of Ukraine. In 2024–2025, their presence in the units of the Armed Forces of Ukraine and the State Special Transport Service became more noticeable, and the issue of their legal status became more relevant than ever.


According to an official clarification from the Ministry of Defense of Ukraine, such foreign citizens are eligible for combatant status (UBD) under the same conditions as Ukrainian military personnel. This is an important step in recognizing their contribution to the defense of Ukraine's independence and strengthening social guarantees.




What laws regulate combatant status for foreigners?


The key document defining the legal status of combatants is the Law of Ukraine “On the Status of War Veterans and Guarantees of Their Social Protection.” According to this law, combatants are recognized as those military personnel who took direct part in activities related to ensuring the defense of Ukraine, protecting its sovereignty, the safety of the population, and state interests in connection with russian aggression.


However, this provision does not apply only to citizens of Ukraine. According to the Law of Ukraine “On Military Duty and Military Service,” foreigners and stateless persons serving in the Armed Forces of Ukraine are also equated with military personnel.


Thus, according to Colonel Serhiy Galimsky, Director of the Social Security Department of the Ministry of Defense, foreigners whose activities meet the requirements of the above-mentioned laws are entitled to receive the status of combatant.


At the same time, starting in June 2025, the right to obtain the status of combatant and person with war-related disability will be enshrined in updates to the regulatory framework, as announced by the press service of the Ministry of Veterans Affairs. Key changes concern the mechanism for submitting documents and determining the authority responsible for granting the relevant status.


It also provides for the introduction of relevant amendments to government decrees No. 413, No. 685, No. 1041, and No. 302, which regulate the procedure for granting UBD status, war-related disability, and other social guarantees.

Who is authorized to grant combatant status to foreigners?


From now on, the only state body authorized to grant foreigners and stateless persons the status of combatant or person with war-related disability is the Ministry of Veterans Affairs of Ukraine.

This provision applies to both current military personnel and those who have already completed their service, regardless of their place of residence. In other words, if a person participated in combat operations on the side of the Armed Forces of Ukraine, their citizenship or possession of a Ukrainian passport is not an obstacle to obtaining this status.

Conditions for foreigners to obtain combatant status


In June, the government decided to unify the conditions for granting UBA status to Ukrainian citizens and foreigners. This means that the same criteria, rules, and grounds for refusal or deprivation of status apply to stateless persons or foreigners as to Ukrainians. This guarantees equal treatment and recognition of the contribution of all those who have defended the state.


To obtain combatant status, a foreign military serviceman must:


● be officially enlisted in the Armed Forces of Ukraine or the State Special Transport Service in accordance with the current legislation;

● perform tasks in the combat zone, as confirmed by relevant documents;

● complete all registration procedures required for Ukrainian citizens.


There are no simplifications or exceptions to the procedure for obtaining this status — foreigners must follow the same procedure as Ukrainian military personnel. After registration, the person receives a corresponding certificate, which gives access to social guarantees provided by law.

How to apply for combatant status


Those eligible for combatant status can apply in two ways:


● By contacting the Ministry of Veterans Affairs of Ukraine (in person or by mail);

● Through Administrative Service Centers (ASC).


The decision on granting status is made by an interdepartmental commission specially created under the Ministry of Veterans Affairs.


If the applicant does not have certain documents necessary to confirm participation in combat operations, the commission has the right to request them independently from the relevant state authorities. At the same time, if the requested documents are not provided, this may be a formal ground for refusing to grant the status.


The total period for consideration of an application is up to 30 days, including the time required for requests and receipt of supporting documents.


Why is combatant status important for foreigners?


Obtaining combatant status not only formalizes a foreigner's contribution to the defense of Ukraine, but also:


● entitles them to benefits in the areas of medical care, housing, taxation, and social assistance;

● increases the chances of obtaining Ukrainian citizenship or a permanent residence permit;

● simplifies interaction with state authorities on issues of legal status and legalization of stay.

How to legalize your stay in Ukraine after military service?


Despite their combat merits, foreigners must officially regulate their migration status in order to continue living in Ukraine or obtain Ukrainian documents. After completing military service or during it, it is possible to:


● apply for a temporary or permanent residence permit;

obtain Ukrainian citizenship, including through a simplified procedure for those who participated in the defense of the state;

● legalize the stay of your family if they are also in Ukraine.
