Importing and registering agricultural machinery in Ukraine: what foreign businesses need to know

Foreign investors who open or purchase agricultural enterprises in Ukraine often face the issue of importing agricultural machinery. It is important to know that any machinery imported and used in Ukraine must be registered and certified in accordance with Ukrainian law. Violation of these requirements may result in the inability to legally use the equipment and legal complications.
One of the key regulatory documents governing this issue is Resolution of the Cabinet of Ministers of Ukraine No. 694 "On Approval of the Procedure for Departmental Registration and Deregistration of Tractors, Self-Propelled Chassis, self-propelled agricultural, road construction and land reclamation machines, agricultural equipment, and other mechanisms." It defines the procedure for registering all types of agricultural equipment in Ukraine.
Certification of equipment prior to registration
Prior to the first registration of tractors, trailers, or interchangeable trailer machines, documents confirming the equipment's compliance with the established requirements must be submitted. These are:
- type approval certificate;
- certificate of conformity to the approved type.
These documents are issued in accordance with the Technical Regulations approved by Resolution of the Cabinet of Ministers No. 1367 and confirm that the equipment has undergone conformity assessment and can be operated in Ukraine.
A type approval certificate can be issued for both serial models and individual samples of equipment. Thus, when importing equipment into Ukraine for the first time, the investor must undergo a certification procedure at an authorized expert institution — this is a mandatory step that cannot be skipped.

Registration procedure
After receiving the certificates, the owner of the equipment applies to the authorized body of the State Service of Ukraine for Food Safety and Consumer Protection at the location of the company or representative office.
Required documents:
- Application for registration.
- Document confirming the right of ownership or use of the equipment.
- Document certifying the identity of the representative and his/her powers (if necessary).
- Certificate of previous registration (if the equipment has been in use).
- Customs declaration or MD-1 receipt (for equipment imported for the first time).
- Certificate of assignment of identification number (if available).
- Expert opinion on the verification of identification numbers.
- Purchase and sale agreement.
- Acceptance and transfer certificate.
Grounds for refusal of registration
Registration may be refused if:
- the equipment does not have an identification number;
- an incomplete set of documents or documents with violations has been submitted;
- the documents are in a foreign language without translation into Ukrainian;
- the identification numbers are damaged or forged;
- the equipment was imported without proper customs clearance or with falsified documents;
- copies of documents are not certified in accordance with the established procedure.
