When can social services abroad take away a child and what should Ukrainians do in this case?

Ukrainians have already faced situations when their children were removed by the relevant services in some European countries. Find out why this can happen and why consuls cannot directly influence the situation

In a number of countries, children can be temporarily removed from their parents or other legal guardians. This can happen if the competent authorities (for example, social services or courts) suspect that the child is in danger or that his or her rights are being violated. This is reported by the Ministry of Foreign Affairs of Ukraine.


When can a child be taken abroad?


Such decisions are made in the following cases:


❗️ Child abuse or violence.

❗️ Threats to the child's well-being.

❗️ Refusal of necessary medical treatment.

❗️ Neglect and breach of parental responsibilities.

❗️ Alcohol or drug abuse by parents or legal guardians.

❗️ Deterioration of the child's living conditions.


In addition, the case may be initiated by third parties, such as neighbours, friends or social workers, who have noticed a potential threat.

What to do in case of temporary removal of a child?


If it happens that social services have taken your child away, it is important to act quickly. Immediately contact the Ukrainian embassy or consulate in the country of residence. The embassy or consulate will be able to provide you with the necessary information and support. A list of all Ukrainian embassies and consulates can be found here.


The consul will help you to find out the circumstances of the child's removal and the grounds for restricting parental rights. He or she can also provide clarification on how to obtain free legal aid in the country of residence.


The consul will advise you on local legislation, in particular in the field of family law, and inform you about human rights organisations that support such cases.


What exactly can a consul not help you with in such a situation?


1. Consuls are not parties to court proceedings. They cannot represent the interests of citizens in criminal or civil cases.

2. Consuls cannot be lawyers and cannot represent you in court.

3. Consuls cannot initiate legal proceedings. However, they can provide you with information and help you find a lawyer.
