New punishment for conscripts: what awaits those who violate the terms of their stay abroad

The Cabinet of Ministers of Ukraine has initiated stricter penalties for conscripts who violate the rules for leaving the country. In particular, this refers to criminalizing cases where men stay abroad longer than permitted by law.


The innovation was announced by government representative in parliament Taras Melnychuk on his Telegram channel.


According to him, the Cabinet of Ministers has approved a draft law that provides for the transfer of all cases under Article 204-1 of the Code of Ukraine on Administrative Offenses (illegal border crossing) to the border service.


Criminal liability for military personnel fleeing abroad: details


The draft law proposes amendments to the Criminal Code of Ukraine, in particular to Article 332. From now on:


1. Illegal transportation of persons across the border will be considered an aggravating circumstance if it occurs during martial law;

2. Criminal liability is established for:

- illegal departure abroad outside checkpoints during martial law;

- damage or destruction of border infrastructure;

- violation of the term of stay abroad by conscripts and persons liable for military service.


Thus, the government proposes not only to strengthen border control, but also to establish a clear obligation for all conscripts and reservists to comply with the terms of their stay outside Ukraine.

Why are new rules being adopted?


Since the start of Russia's full-scale invasion of Ukraine, there has been a significant increase in the number of illegal schemes for conscripts to leave the country. Organisers offer such “services” for 4,000-10,000 dollars, but border guards regularly detect and stop these offences.


The government emphasizes that all such attempts are illegal, and tougher penalties should serve as an additional deterrent for those trying to evade military service.
