When motor insurance does not work: in what cases can the driver be required to pay 100% of the insurance compensation?

Every driver in Ukraine is required to have motor vehicle insurance, but few people know that in some cases, insurance may become completely invalid. If you violate the law or the terms of the contract, the insurance company has the right to demand that you return the entire amount of compensation. According to Ukrainian law, every vehicle on public roads must have motor third-party liability insurance. However, there are situations when a vehicle is not covered by insurance, and in such cases, the driver risks being required to reimburse the entire amount of compensation paid by the insurance company. This was reiterated by the Motor Transport Insurance Bureau of Ukraine, according to Ukravtoprom.

When is recourse from insurance possible?
The MTIBU and insurance companies have the right to demand full reimbursement from the driver if the accident occurred under the following circumstances:
▪️ Intentional commission of an accident — except in extreme cases, such as necessary defence or life-saving actions.
▪️ Driving while intoxicated, under the influence of drugs or medication that impairs attention.
▪️ Driving without a licence — without a driving licence.
▪️ Fleeing the scene of an accident.
▪️ Refusal to undergo a medical examination.
▪️ Driving a technically faulty vehicle that could have directly contributed to the accident.
▪️ Using the vehicle to commit a crime.
▪️ Transporting passengers or goods for a fee if the policy was issued with a 50% discount (usually for personal use).
What can the insurance company demand if the rules are violated?
If the driver has violated the law or the terms of the MTPL agreement, the insurance company or the MTIBU has the right to:
1. Refuse to pay insurance compensation, or
2. Demand recourse — a refund of 100% of the compensation previously paid.
If one of the above violations is detected, the insurance contract is cancelled from the moment of the accident, and compensation will be recovered in full.

Who is required to have MTPL?
According to Ukrainian law, every car, regardless of its registration status in Ukraine (including temporarily imported cars), must have MTPL insurance.
MTPL covers damages to third parties (material, moral, life/health) within the limits.
In the absence of a policy, invalidity or bankruptcy of the insurer, payments are made by the MTIBU, but in exceptional cases provided for by law.
