In such cases, you can start the inheritance process remotely, but it is important to prepare all documents correctly and adhere to the established deadlines. In this article, we will explain how to register an inheritance while outside Ukraine, what you need to do and how to avoid common mistakes.


Can you register an inheritance while abroad?


Yes, Ukrainian citizens who are abroad can register an inheritance in Ukraine. This process is regulated by Ukrainian law, and there are several ways to apply for inheritance. It is important to remember that there are certain deadlines and documents that must be prepared.


General conditions for inheritance — the process of registering an inheritance is possible both by law and by will. To do this, the heir must submit an application to a notary within six months of the testator's death.


Mandatory deadlines — the six-month period for submitting an application begins on the date of the testator's death or from the moment of official recognition of their death.


Possibilities for submitting an application through a consulate or notary — Ukrainian citizens abroad can submit an application through consular offices or by power of attorney.


What documents are required?


To register an inheritance from abroad, you need to prepare a number of documents:


- Application for acceptance of inheritance (notarised).

- Copy of the heir's passport.

- Death certificate of the testator.

- Documents confirming family ties (birth or marriage certificate).

- Will (if any).

- Notarised power of attorney for a representative if you need the help of a lawyer or representative to submit the application.

Some steps in the inheritance process can be completed remotely:


1. Submitting an application through the consulate — citizens abroad can contact the Ukrainian consulate, which will certify the application for acceptance of the inheritance. The application is then sent to Ukraine.


2. Certification of documents — in order for documents such as a death certificate or will to be recognised as valid in Ukraine, they must be apostilled or legalised. This can be done through the consulate.


3. Power of attorney — if necessary, you can draw up a notarised power of attorney for a representative who will handle the inheritance process in Ukraine.

Errors in documents — it is important to carefully check all documents before sending them. Errors in surnames, dates or missing signatures can slow down the process.


Inability to collect all documents — in some cases, documents may be required that are difficult to obtain from abroad. For example, if there is no death certificate, it can be requested through the consulate.


Difficulties with deadlines — it is important to remember the six-month deadline for submitting an application. If the deadline expires, you will need to apply to the court to have the deadline extended.
