Foreign students who wish to study in Ukraine must obtain a temporary residence permit on the basis of their studies. This is an important document that allows them to legally stay in Ukraine for the entire period of their studies. The process of obtaining a residence permit can be complicated and requires careful preparation of documents, knowledge of legal requirements, and interaction with the relevant authorities. Who is eligible for a residence permit for study purposes?

Foreigners who meet the following criteria are eligible for a temporary residence permit in Ukraine:

▪️ have been officially enrolled in a Ukrainian educational institution;

▪️ have obtained a D-13 visa (if required by law);

▪️ have a valid passport or identity document;

▪️ have signed a contract for study at a higher education institution.

Procedure for submitting documents and legal requirements

To obtain a temporary residence permit on the basis of study, first of all, you must already be a student of a Ukrainian higher education institution at the time of application.

Documents must be submitted no later than 25 days before the expiry of your visa or visa-free stay.

At the same time, foreigners or stateless persons who have reached the age of 16 or have not reached the age of 16 but have arrived in Ukraine independently for the purpose of studying must submit their applications in person.

The Migration Service of Ukraine is the authority that accepts documents from foreign students. At the time of applying for a residence permit, you must have either a D-13 visa or be a citizen of a country with which Ukraine has a visa-free regime.

What documents are required to obtain a residence permit in Ukraine on the basis of study?

The documents required for this type of permit include:

— a valid foreign passport (or passport documents if the foreigner has dual citizenship (multiple citizenship) or a document certifying statelessness, with a D-type visa, unless otherwise provided by the legislation and international treaties of Ukraine;

— a document certifying the identity of the legal representative and a document confirming the person's authority as a legal representative (if the documents are submitted by a legal representative) (the originals of the documents are returned after presentation, copies are submitted);

— a translation into Ukrainian of the page of the foreigner's passport or document certifying the stateless person's identity, containing personal data, certified in accordance with the procedure established by law;

— a valid medical insurance policy for the entire period of validity of the type and a copy thereof;

— a document confirming payment of the administrative fee or a document exempting the applicant from paying it (the original will be returned after presentation, a copy will be submitted);

— a submission from the relevant state body responsible for implementing cultural, educational, scientific, sports, and volunteer programmes, for participation in which the foreigner or stateless person has arrived in Ukraine;

— a document confirming the fact of study in Ukraine (certified copies of the educational institution's order on enrolment and the establishment of study periods for foreign students);

Please note! The passport must be issued for 10 years, have at least 2 free pages and be valid for at least one year at the time of entry into Ukraine.

Issuance period and refusal decision

The permit is issued within 15 working days from the date of receipt of documents from a foreigner or stateless person.

The decision to refuse to issue, exchange or cancel the permit may be appealed by a foreigner or stateless person through administrative channels within thirty calendar days from the date of its notification to the foreigner or stateless person, or in court in accordance with the established procedure.

The appeal against the decision to refuse to issue, exchange or renew a residence permit must be accompanied by documents confirming the grounds for its review and cancellation.
