How to spot scammers among immigration “assistants” in the US: tips for Ukrainians

Immigration fraud is a common threat to Ukrainians in the US. Learn how to spot fake “assistants,” avoid mistakes, and find out who you can really trust with the legalization process in the country

During periods of mass immigration, when thousands of Ukrainians in the US are looking for ways to legalize their status, unfortunately, fraudsters also become more active. Immigration fraud is one of the biggest threats to newcomers, as not everyone understands the difference between a licensed attorney, an accredited representative, and a regular “assistant” who does not actually have any legal right to provide such services.


Who are these fake immigration “assistants”?


Immigration fraudsters are usually individuals who:


● do not have a license to practice law in the US;

● present themselves as “immigration consultants,” “notaries,” or “document assistants,” but charge for full legal services;

● make false promises, such as “100% guarantee of a green card,” “legalization without documents,” etc.;

● offer illegal methods of legalization, including sham marriages or false documents.


Unlike licensed lawyers, such individuals are not legally responsible for their actions, but can put a person at risk of deportation, loss of status, or a ban on entry into the United States. As a result, the responsibility is shifted to the client, even if they acted on the advice of an “assistant.”

How to recognize immigration fraud: signs to look out for


Be wary if a person:


● does not provide proof of their license or is not registered with the state BAR Association;

● demands cash prepayment without a check or receipt;

● refuses to enter into a written contract for the provision of services;

● asks you to provide false information on USCIS forms;

● offers to process documents through fake marriages, fictitious companies, or other questionable schemes;

● promises “coordination with the immigration service” or “guaranteed results” or assures that everything is “coordinated” with the immigration service (USCIS);

● provides only a phone number or messengers — without an address or official office.


These actions are direct indicators that you are not dealing with a professional, but a potential fraudster.

How can Ukrainians in the US protect themselves from fraud?


1. Check the lawyer with the State Bar

Every licensed lawyer must be registered with the bar association of the state in which they practice. You can check this online on the official website by entering their name or license number.


2. Only contact accredited representatives

Only attorneys or accredited representatives of organizations recognized by the DOJ are authorized to prepare documents and represent you in immigration matters. No one else is authorized to prepare documents for you or contact USCIS on your behalf.


3. Sign a written agreement

Always request a formal contract for legal services. This is your protection in case of unforeseen circumstances. Always read all the terms of the contract carefully, keep copies of all documents and payment receipts.


4. Never provide false information on forms or applications

Even if you are advised to provide false information, remember that you will be held responsible by the law.


5. Don't be fooled by “guaranteed results”

No lawyer can guarantee a positive outcome, as the final decision always rests with USCIS or the immigration court. A lawyer can only provide you with professional guidance, prepare all the necessary documents, and represent your interests in accordance with the law.


What to do if you have already fallen victim to fraud?


If you have already encountered a dishonest “assistant”:


● Immediately contact a licensed immigration lawyer — they will be able to assess your chances of rectifying the situation.

● Report the incident to USCIS or the state prosecutor's office.

● Do not delay — time is of the essence in immigration cases, especially if incorrect documents have been submitted.
