Mobilisierung ab 25: Wer ist jetzt verpflichtet, in der Ukraine zu dienen

On 2 April, President of Ukraine Volodymyr Zelenskyy signed several bills that directly affect mobilisation in Ukraine. In particular, the President lowered the age of mobilisation from 27 to 25 years and cancelled the status of "limitedly fit".

Mobilisation from the age of 25

Thus, the Ukrainian leader signed Law No. 9281, which the Verkhovna Rada voted for last year. This law is not part of the high-profile draft law on mobilisation, which lawmakers are still considering in parliament.

"Male citizens of Ukraine who are fit for military service for health reasons, who have turned 18 years old by the day of departure to a military unit, and older persons who have not reached the age of 25 and are not entitled to exemption or deferment from conscription, are called up for regular military service," the document says.

At the same time, it specifies that during martial law, conscription commissions must conduct a medical examination of conscripts who are registered with the military and have reached the age of 25. And if they are found fit for military service, they will be registered with the military and recognised as liable for military service. 

This means that men aged 25 can be mobilised into the army, even if they have not served in the military and have no military experience. 

The law comes into force on the day following its publication.

Zelenskyy also signed draft law No. 10062 on improving the procedure for processing and using data from registers for military registration and obtaining the status of a war veteran.

In particular, it allows the transfer of Ukrainian military IT systems to the cloud storage of NATO member states as part of strengthening cyber defence. It also provides for the launch of digital credentials (certificates) with the improvement of the Oberih system - the electronic register of conscripts, persons liable for military service and reservists. In addition, it is planned to launch an e-services portal that will allow for online, offline or automatic registration of combatant status if the necessary data is available in the system.

The register will contain information on all conscripts, persons liable for military service and reservists aged 17 to 60.

It will be filled with information through electronic interaction with information and communication systems, registers, and databases maintained by government agencies.

The Register will be accessible to the Ministry of Defence, the Security Service of Ukraine, intelligence agencies, operational commands, and regional TCCs. 

The Register will contain the following information:

- personal data of conscripts, persons liable for military service and reservists;

- service data of conscripts, persons liable for military service and reservists;

- data on the need to recruit personnel for the Armed Forces of Ukraine and other military formations established in accordance with the laws of Ukraine, except for information constituting a state secret.

The e-office is expected to be launched in the second quarter of 2024.

Cancellation of the restricted period

Prior to the adoption of this law, there were three types of decisions of the military medical commission on potential conscripts in Ukraine: fit, limited fit, and unfit.

Now, draft law No. 10313 has been signed, which excludes the status of "limitedly fit". Thus, the medical commission can make two conclusions - fit or unfit.

The law also establishes an obligation for Ukrainians who have previously been declared partially fit to undergo a second medical examination within 9 months. However, such an examination will be possible after the bylaws are brought into line with the new law. 

In addition, the law now provides for the payment of UAH 15 million to the family of a fallen soldier.
