What to do after U4U status in the United States: legalization options for Ukrainians

U4U status for Ukrainians in the United States has a limited duration. Find out what legalization options are available after it expires and how to avoid illegal status
The Uniting for Ukraine (U4U) program became a lifeline for tens of thousands of Ukrainians who were forced to seek refuge because of the full-scale war. It provided an opportunity to temporarily stay in the United States on the basis of a humanitarian password for up to two years. However, with the suspension of the program and the approaching expiration date, a critical question arises: what to do next to stay in the United States legally?
How do I stay in the United States after my U4U parole expires?
In this article, we will look at six realistic ways of legalization that are available to Ukrainians after graduating from U4U. We will also give advice on the steps you need to take in advance.
1. Temporary protection (TPS - Temporary Protected Status)
TPS is one of the fastest ways to stay in the United States legally after U4U. What TPS gives you:
● legal presence in the United States;
● work authorization (EAD);
● protection from deportation.
Who can apply for TPS:
● persons who have been in the United States since a certain date (for example, until August 10, 2023, depending on USCIS updates);
● those who do not have serious offenses;
● those who have applied for TPS through Form I-821.
It is important to understand that TPS does not lead to a green card, but it allows you to live and work legally. For many, it is a “respite” that allows them to gain time and plan their next steps.
2. Political asylum (Asylum)
This option is possible for those who have personal reasons to fear returning to Ukraine, for example, due to war, persecution, political beliefs, membership in a social group, etc.
Key points:
● the application must be filed within one year of entering the United States (in the case of U4U, from the date of arrival);
● the application is made using Form I-589 (application for asylum);
● if the asylum is approved, the path to obtaining a green card is opened.
This path can be effective, but requires a strong evidence base. It is recommended to apply with the support of a qualified lawyer: legal assistance significantly increases the chances of success.
3. Marriage to a U.S. citizen
This is one of the most reliable and direct ways to legalize through family reunification.
Conditions:
● a valid (not fictitious) marriage must be concluded;
● submission of Form I-130 (petition for family reunification) and Form I-485 (application for adjustment of status);
● even after completing U4U, you can still apply if you have not violated other immigration rules.
At the same time, you can apply for a work permit (EAD) and travel authorization (Advance Parole) at the same time as you apply for adjustment of status.

4. Student status (F-1)
This option is suitable for those who plan to continue or start studying in the United States.
Steps required:
● enroll in an accredited university or college;
● obtain a Form I-20 from the educational institution;
● file a Form I-539 application to change your status from U4U to F-1.
Features:
● student status does not automatically grant work authorization (except for educational practice - OPT or CPT);
● you need to confirm your financial ability to cover tuition and living expenses.
This is a good option for young people or those who see their future in the United States through education.
5. Work visas (H-1B, O-1, EB-3)
Although this path is more complicated, it is realistic with the support of an employer.
Popular types of visas:
● H-1B - for specialists with higher education, requires a lottery and a quota;
● O-1 - for people with outstanding abilities in science, art, sports;
● EB-3 - for skilled and unskilled workers, provides a path to a green card.
All of these options require an employer who is willing to file a petition and provide support in the paperwork. The participation of an immigration lawyer also significantly increases the chances of success.
6. Re-applying for a humanitarian parole (re-parole)
As of 2025, the USCIS has not yet provided a clear mechanism for U4U renewal. However, it is worth keeping an eye out for updates: perhaps a special re-parole mechanism will appear in the near future, as has already been done for Afghan refugees.
Currently, it is possible to apply for re-parole individually through Form I-131. However, it is worth remembering that the decision is made at the discretion of the immigration service, so there may be few chances of approval.
What to do right now: tips for those whose U4U status is coming to an end
1. Start acting early - at least 4-6 months before your password expires.
2. Gather documents confirming your status, location, petitions, etc.
3. Consult with a qualified immigration lawyer to choose the best path.
4. Apply for adjustment of status or other available forms of legalization.
