Is it possible to apply for a work visa to the Netherlands while staying in Poland?
Yes, you can apply for an employment visa for the Netherlands while you are abroad, in particular in Poland. You do not have to return to Ukraine to do this. However, the process depends on several factors:
- The type of work you do and your qualifications.
- The willingness of your employer (a Dutch company) to sponsor your visa.
- Compliance with the conditions of the Dutch immigration legislation.
1. How to apply for an employment visa for the Netherlands?
Stages of registration:
- The employer applies for a Work Permit. A work visa to the Netherlands is usually issued on the basis of a work permit submitted by your employer to the Dutch immigration service IND (Immigratie- en Naturalisatiedienst). The employer must prove that they could not find an employee for the position among EU citizens. If you have a highly skilled position, the process is simplified (Highly Skilled Migrant category).
- Obtaining an MVV (D-Visa) - a visa for long-term stay. After the approval of your work permit, you apply for an MVV visa at the Dutch consulate in your country of residence (e.g. Poland).
- Apply for a residence permit. Upon arrival in the Netherlands, you need to register with the municipality (Gemeente) and obtain a residence permit.
2. What documents are required to apply for an MVV (long-term resident visa)?
- Proof of employment (employment contract from a Dutch company).
- A work permit (applied for by the employer).
- Passport valid for at least 6 months after the date of application.
- Health insurance.
- Proof of residence in the Netherlands (e.g. a rental agreement).
- Ticket to the Netherlands (if you plan to move after the visa is issued).
3. What is important to consider in your situation?
- Current status on the A1 form. Form A1 is used for temporary secondment of employees within the EU. This means that you work through a Polish agency, but social security contributions are paid in Poland. If you plan to stay in the Netherlands longer and apply for a work visa, your employer in the Netherlands must apply for you as an individual employee.
- Change of status. If you want to stay in the Netherlands without being seconded through a Polish agency, you need to change your status from a seconded employee to a permanent employee of a Dutch company. This involves a new contract and sponsorship from your employer.
If you are planning a trip abroad, the lawyers of Visit Ukraine will help you prepare a package of documents in accordance with the requirements of a particular country. Experts will explain in detail all the nuances of applying, check its correctness, and help you avoid common mistakes that can lead to delays or rejection.
4. What to do next?
- Contact your employer in the Netherlands. Find out if they are willing to sponsor your work visa. Ask your employer to apply for a work permit at the IND.
- Apply for an MVV at the Dutch consulate in Poland. The nearest Dutch consulate in Poland can be found on the official website: nederlandwereldwijd.nl.
5. Useful contacts
- IND (Immigratie- en Naturalisatiedienst). The official website is ind.nl.
- Consulate of the Netherlands in Warsaw. Address: ul. Kawalerii 10, 00-468 Warsaw, Poland. Phone: +48 22 559 12 00. E-mail: war@minbuza.nl.
You can apply for an employment visa for the Netherlands while you are abroad, in particular in Poland. To do this, your Dutch employer must apply for a work permit and you must apply for a long-term MVV visa. If your current A1 status raises questions, it is recommended to consult an immigration lawyer.
