Under current Ukrainian law, violations of traffic rules are subject to severe penalties, including deprivation of the right to drive a vehicle. Such an administrative penalty can only be imposed by a court.

The main reasons why drivers may be deprived of their driving privileges


There are a number of serious traffic violations in Ukraine that may result in drivers being deprived of their driving privileges. Let's look at the main cases regulated by the Code of Ukraine on Administrative Offenses.


Driving while intoxicated


According to Art. 130 of the Code of Administrative Offenses, a driver is deprived of his or her license for:

- Driving under the influence of alcohol, drugs or other intoxicants;

- Refusal to undergo a medical examination;

- Drinking alcohol after an accident before the test.

The term of deprivation ranges from 1 to 10 years, depending on the circumstances and the repetition of the violation.


Creating an emergency situation


For a traffic violation that forced other road users to change their speed or direction, the court may deprive the driver of their license for 6-12 months (Article 122 of the CAO).


Ignoring police demands


Failure to comply with a lawful police request to stop a vehicle is punishable by deprivation of rights for 3-6 months.

Violations at a railroad crossing

Driving at a railroad crossing with a prohibited signal or closed barriers is punishable by deprivation of rights for 1-3 years (Article 123 of the Code of Administrative Offenses).


An accident due to traffic violations


If the violation of the rules caused damage to property or an accident, the driver may be deprived of his or her license for 6-12 months (Article 124 of the Administrative Code).


Driving a faulty car


For the repeated use of a technically defective vehicle within a year, the license may be taken away for 3-6 months (Article 121 of the Administrative Code).

Are foreigners punished for traffic violations?


Foreign drivers who are on the territory of Ukraine are obliged to comply with the traffic rules on an equal footing with citizens of the country. In case of violation, foreigners are subject to the same sanctions as Ukrainian drivers. Traffic rules are enforced by the National Police, and fines are imposed in accordance with the Code of Administrative Offenses.

In addition, foreign drivers may be deprived of the right to drive a vehicle in case of serious traffic violations that endanger other road users.


Another important issue for foreigners is car insurance in Ukraine. Foreigners with a residence permit and a car with Ukrainian registration can obtain motor third-party liability insurance on the same terms as Ukrainian citizens.

If the car has a foreign registration, a standard motor citizen is not available. However, you can use Mini Hull Insurance to protect your car.

How do I get my driver's license back?


After the driver's license has been revoked, there are several mandatory steps to take to get it back.

First, you need to pass a theoretical and practical test for the right to drive a vehicle of the appropriate category. These exams confirm that the driver has retained the necessary qualifications. This requirement applies to persons punished under Articles 124 or 130 of the Code of Ukraine on Administrative Offenses (CAO).

An extraordinary medical examination is also required for those who have been deprived of their rights for driving under the influence of alcohol or drugs.


Next, you need to contact the territorial service center of the Ministry of Internal Affairs with the following documents:

- A copy of the court decision;

- Application;

- Passport or a document that replaces it;

- Medical certificate of the established form (if necessary);

- Receipt of payment of the administrative fee.

You can also apply for the return of your license through the Diia portal, which makes the procedure more convenient for drivers.

The most common fines for traffic violations in Ukraine


Fines for traffic violations are not only a punishment, but a real payment for safety. Under the threat of losing money, most road users refuse to commit violations. But what exactly do the police most often fine drivers for in Ukraine?


Speeding


Speeding is one of the most common traffic violations in Ukraine. In populated areas, the maximum speed is limited to 50 km/h, and in residential areas and adjacent zones - up to 20 km/h. Outside of settlements, you are allowed to drive up to 90 km/h, and on highways - up to 130 km/h.

The fine for exceeding the speed limit by more than 20 km/h is UAH 340. If the violation exceeds 50 km/h, the driver will pay a fine of UAH 1,700. Compliance with the speed limit is important for road safety.


Running a red light


Running a red light is a serious violation that puts not only the driver but also other road users at risk. This rule is not a recommendation, but a strict order to stop. Ignoring it is punishable by a fine of UAH 510.


Driving and stopping in the transport lane


The lanes intended for public transport are prohibited for private vehicles. The fine for such a violation is UAH 680. In addition, parking or stopping closer than 30 meters to a public transport stop is subject to a fine of UAH 340.


Crossing a double solid line


A double solid line is a clear signal that overtaking or crossing is prohibited. A driver is liable to a fine of UAH 340 for violating this rule. This violation creates a danger for all road users.


Ignoring turn signals


Before performing a maneuver, the driver is obliged to give turn signals. Ignoring this requirement is punishable by a fine of UAH 510, and in case of an emergency, up to UAH 1,445.


Seat belts


The use of seat belts is mandatory for all passengers and the driver. Violation of this rule is punishable by a fine of UAH 510.


Rules for the transportation of children


Children under 150 cm in height may be transported only in special car seats or boosters. The first violation is punishable by a fine of UAH 510, and the repeated violation within a year - UAH 810.


Drinking alcohol while driving


Driving while intoxicated is strictly punishable by law in Ukraine. Fines for this offense range from UAH 17,000 to UAH 51,000, depending on the circumstances and the frequency of the offense. In addition to fines, a driver's license may be revoked for a period of one to ten years.

The amount of the penalty is determined based on the number of violations during the year. If drunk driving causes a traffic accident with victims, criminal liability is added to administrative liability.


Lack of insurance


Mandatory civil liability insurance provides compensation for damages to the injured party in an accident. The absence of a policy is punishable by a fine of UAH 425, and in case of non-payment within 15 days - UAH 850.
