According to the government portal, Ukraine loses between $50 million and $150 million annually due to non-transparent customs clearance of cars. The reason for this is that under the current rules, customs officers can set the customs value of a car at their own discretion, from which tax is deducted.

Therefore, in order to simplify the customs clearance process and eliminate the human factor and corruption, the Verkhovna Rada adopted in the first reading a draft law that will allow customs clearance of cars through an action. “269 MPs voted in favor.

After the bill is adopted in its entirety, only the constant characteristics of the car, which cannot be influenced by humans, will be used to calculate the price of customs clearance. Information on the cost will be checked against the database.

How will the customs clearance of cars be carried out through Diia?

In general, the project proposes to introduce an electronic database that will be used to adjust the customs value of vehicles. The database will store data on the customs value of new passenger cars, taking into account the make, model, engine size, and fuel type.

In addition, the draft law provides for the adjustment of the customs value of used cars. The respective mechanism will be developed separately and will be applied if the declared customs value is lower than the value of a car identical in brand, commercial description and characteristics (year of manufacture, engine type and capacity, etc.) according to the information in the Database.

The customs clearance process is expected to take no more than an hour. To complete the process, the user will only need to log in to Diia, select the desired service, and specify the VIN code, invoice value of the car, and additional information about the car.

Diia will automatically calculate customs payments, generate a customs declaration, and, after the user's signature, submit it to the customs. Correction of the submitted information will be possible only in clearly defined cases. Therefore, the user will only have to pay customs duties. After the funds are transferred from the bank to the customs account, the car will be able to cross the border.

When will it be possible to clear cars through Diia?

The draft law is currently awaiting a second reading. If adopted, it will come into force the day after its publication. At the same time, in order for the new car customs clearance scheme to take effect, the authorities must

– within 3 months of the law's publication, bring regulations in line with the innovations;

–  within 6 months - to ensure technical implementation of the submission of customs declarations by citizens through Diia and to create a database of the customs value of passenger cars;

– within 9 months - to ensure the technical implementation of the submission of electronic customs declarations by enterprises through Diia.
