The Verkhovna Rada has approved Law No. 9453, drafted by the Ministry of Social Policy of Ukraine, on the calculation of insurance record for persons who worked abroad. The relevant changes in legislation relate to pensions and include several innovations.

According to the Ministry, as a result of russia's large-scale invasion, Ukraine has severed diplomatic relations with the aggressor country. This has led to the cessation of contacts and the exchange of documents between state institutions, including pension funds. As a result, Ukrainians who moved from the temporarily occupied territories could not confirm their lack of right to a pension from the pension authorities of the russian federation and receive a pension in Ukraine.

In addition, russia and Ukraine withdrew from the agreement on guarantees of citizens' rights in relation to pensions. This led to the fact that Ukrainians who worked in other CIS countries lost the possibility to include this period in their insurance record in Ukraine, which reduced their pension rights.

Ukrainians who worked abroad will receive a pension: what changes have been introduced

One of the key aspects of these changes is the calculation of the pension amount based on the insurance period acquired both in Ukraine and abroad. Also, the length of service gained in the countries of the former USSR is now taken into account. 

In addition, the amendments establish the conditions of pension provision for military personnel with insurance service acquired in the russian federation.

Additionally, it is proposed to expand the list of reasons for termination of pension payments, including temporary stay abroad at the pensioner's own request or declaration of a person as missing or deceased. It also supports annual verification of pensioners who are temporarily abroad to continue paying their pensions.

“It is important to note that only contributions/SC paid in Ukraine will be taken into account when determining the amount of pension (i.e., the proportional principle of pension calculation). Thus, the amount of the pension will depend on the number of insurance contributions paid in Ukraine (the more contributions, the higher the pension) and the length of service gained before January 1, 2024, including work both in Ukraine and abroad,” the statement emphasizes.

Also, work for the aggressor country after 2014 will not be included in the pensionable service record in Ukraine.

The law provides for the exclusion from the pensionable service record from 19 February 2014 of periods of military service in the security forces, participation in illegal armed or paramilitary groups, work in the judicial or law enforcement agencies of the aggressor country in the temporarily occupied territories, and voluntary positions in illegal authorities.
