Nach vielen Monaten der Prüfung eines der Hauptgesetze der Ukraine hat der zuständige Ausschuss der Werchowna Rada endlich seine Arbeit abgeschlossen und wird einen aktualisierten Gesetzentwurf der Werchowna Rada vorlegen. The relevant Parliamentary Committee has completed its consideration of the updated law on mobilization and today, April 10, it is to be submitted to the Parliament. This was announced by MP Oleksiy Honcharenko. A summary comparative table should be available before the process begins. However, some changes are already known. We will describe them in detail in the article below.
Exclusion of demobilization from the draft law on mobilization
First of all, it has become known that the Verkhovna Rada Committee on National Security and Defense has excluded the provisions on demobilization and rotation of military personnel from the government's draft law on mobilization. The issue was initiated by the Commander-in-Chief of the Armed Forces of Ukraine, Oleksandr Syrskyi.
The government agreed with the proposal of the Ministry of Defense, so now the Cabinet of Ministers has eight months from the date of adoption to develop and submit a bill to improve the mechanisms for rotation of military personnel during martial law, their demobilization and medical and social rehabilitation.
Tax evaders will be banned from driving, but there are exceptions
As part of the consideration of the draft law, an amendment was made to prohibit driving for persons evading military registration. However, as MP Oleksiy Honcharenko wrote, this restriction will have a certain procedure and may not apply to everyone.
Thus, the Committee proposed a new algorithm for identifying evaders and bringing them to justice. Territorial recruitment and social support centers (TSC and SP) will first take independent measures to find violators. In particular, an option was proposed for consideration that the head of the institution should contact the police to search for and detain persons who failed to appear under summons. If law enforcement officers testify that they cannot bring in and detain such citizens, the TSC will send a "demand" for voluntary appearance to the evaders by registered mail.
If the citizen fails to comply within 10 days, the military commissions will have the right to apply to the court, which will decide within 30 days whether to restrict the driver's right to drive a vehicle. If there is clear evidence of a citizen's evasion of military registration and if the relevant decision is made, the executive service will be entrusted with the task of restricting the right of the evader. The term of such restrictions is set until the person fulfills the requirements of military registration.
At the same time, the draft law provides for exceptions when restrictions on the right to drive a vehicle are unacceptable. In particular, restrictions cannot be applied
– to persons whose income is related to driving (taxi drivers, officially employed drivers, individual entrepreneurs engaged in transportation, etc;)
– persons with disabilities;
– persons supporting persons with disabilities of groups I-II or a child with a disability.

Other important provisions in the updated draft law on mobilization
1. The provision on the right to demobilize people with disabilities remains.
2. Demobilization in connection with the release from captivity (if the servicemen did not express a desire to continue military service).
3. Those recognized as partially fit will be required to undergo a re-evaluation within 12 months.
4. Servicemen and women who sign their first contract are entitled to compensation for 50 percent of the down payment on a mortgage-backed loan.
5. Those who received a 2-3 disability group after February 24, 2022 (except for military personnel) are subject to a second medical examination to determine their fitness for service.
6. Restrictions on consular services for men aged 18 to 60 without military registration documents. Read more about this here.
It is expected that today the Parliament will start considering the amendments taken into account and rejected by the Committee (starting with the second ones). According to Yaroslav Zheleznyak, everything will be decided when the Rada votes for each of the rejected amendments, namely, when the Committee starts considering the amendments taken into account.
"Each MP can put each such amendment "for confirmation". That is, in order to keep it, it is necessary to get 226+ votes for each amendment in the hall. Otherwise, it becomes rejected and the text returns to the first reading version," he explained.
After this stage, the law will be subject to a final vote. The law should come into force one month after its adoption, and the government should prepare all the regulatory documents during this time.
