As you know, Poland has extended temporary protection for Ukrainian refugees until 30 June 2024, refusing to extend it for another year. However, some citizens will be able to stay in the country for a longer period. With reference to uapl.info, we tell you who has this right.

The new regulation on temporary protection for Ukrainians in Poland came into force on 22 February and, if not extended, will expire on 30 June, but at least five categories of Ukrainian refugees will be able to stay in Poland longer than this. 

Who can stay in Poland after 30 June?

The right to stay in Poland after 30 June is still granted to Ukrainian children of pre-school and school age enrolled in the Polish education system. Their parents or legal guardians staying with them in Poland are also eligible.

Thus, until 31 August, the right to legal residence will be granted to citizens who, as of 30 June 2024, will

- use Polish preschool education;

- receive compulsory school education or compulsory other education in Poland.

Ukrainian citizens with minor children studying remotely in the Ukrainian education system will also have this right.

Until 30 September 2024, Ukrainians can legally stay in Poland to re-sit the final exam in Polish educational institutions. In the case of minors, their parents or guardians may stay with them.

Who can stay in Poland only until 30 June?

The Polish Office for Foreigners emphasises that the above-mentioned extended periods of stay apply exclusively to Ukrainians who have been granted the status of UKR in Poland.

At the same time, for other categories of Ukrainian migrants, including parents of children studying in Polish educational institutions, the validity of certain documents has been extended only until 30 June 2024.

In particular, it concerns Ukrainian migrants staying in Poland on "extended" legalisation or visa documents.

Please note that the terms have been extended until 30 June:

- validity of legal residence permits and Polish national visas of Ukrainian citizens;

- validity of legal residence certificates of Ukrainian citizens;

- departure of Ukrainian citizens from the territory of Poland who are legally staying in the country;

- for voluntary return;

- validity of legal residence certificates, Polish identity documents of a foreigner;

- "tolerated residence permit" documents issued to Ukrainian citizens.

In addition, until 30 June 2024, the stay of Ukrainian citizens in Poland under the visa-free regime is considered legal. In addition, in connection with the expiry of a short-term residence permit, in particular on the basis of a Schengen visa issued by Poland or another Schengen country, or a residence permit issued in another Schengen country.
