By Resolution No. 1405 dated 29 December 2023, the Cabinet of Ministers of Ukraine lifted the ban on the termination of housing and communal services, the charging of penalties and fines in case of arrears.

The lifting of the moratorium came into force on December 30, 2023.

From now on, the moratorium on disconnection of utilities will apply only to the temporarily occupied territories and in the combat zones, and the list of these communities will be approved by the Ministry of Reintegration.

It is emphasized that subscribers will not be disconnected from utility services due to debt if their real estate is damaged as a result of hostilities. In such cases, the owner must notify the relevant utility company.

What should Ukrainians abroad do?

For people living abroad, it is important to note that many residential complexes provide standard fixed services that all residents must pay for, regardless of whether they live in the apartment or not. These services include cleaning and maintenance of the territory, elevator maintenance, garbage collection, and others.

If the consumer has traveled abroad and is temporarily staying there, this does not exempt them from the obligation to pay for utilities. 

In case of non-payment of the total amount, a penalty will be charged, and subsequently fines and even disconnection from services are possible. To avoid negative consequences, it is recommended that you make payments on time and, in case of difficulties, contact the relevant services to agree on payment options or resolve other issues.

How will a penalty or fine be charged and what are the terms of payment?

As for the amount of penalties and fines, they are determined in accordance with the terms of the agreement. However, the fine may not exceed 0.01% of the debt amount for each day of delay. The total amount of the penalty paid should not exceed 100% of the debt amount.

It is important to note that consumers who have debts after December 30, 2023, will receive a warning and must pay the debt, otherwise they will be subject to penalties and fines, as well as possible disconnection from services.
